These Terms and Conditions (“Terms”) constitute a legally binding agreement between you and Jomivic Consulting, trading as Jomivic Recruitment Agency, a recruitment and consultancy business operating in Ireland and internationally (“Jomivic”, “we”, “us”, or “our”). By accessing or using our website or services, you agree to be bound by these Terms. If you do not agree, you must not use the website or services.
Section 1
The Services
Jomivic provides professional recruitment, staffing, talent acquisition, and recruitment consultancy services to employers and job seekers in Ireland and internationally. Services include (without limitation) identification, screening, and introduction of candidates to prospective employers, advertising and promotion of opportunities, coordination of interviews and communications, and recruitment-related advisory services.
Jomivic acts solely as an intermediary between employers and candidates and does not, unless expressly agreed in writing, employ candidates or enter into any employment relationship with them.
You acknowledge that Jomivic does not guarantee that any candidate will be offered employment, that any vacancy will be filled, or that any employment relationship once formed will continue for any minimum period. Employment decisions (including hiring, remuneration, working hours, and termination) are made solely by the employer. Any information about roles, salaries, benefits, or working conditions is indicative only and may be amended, withdrawn, or corrected at any time by the employer.
Important acknowledgements
- Submission of a CV or registration with Jomivic does not create an employment relationship with Jomivic.
- Jomivic does not supervise, direct, or control the work of any candidate.
- Any contract of employment or engagement is strictly between the employer and the candidate.
For recruitment outside Ireland, Jomivic acts strictly as an intermediary and makes no representations or warranties regarding visa approvals, work permits, residency permissions, or immigration outcomes. Compliance with applicable immigration, labour, tax, and employment laws is the responsibility of the employer and/or the candidate. Jomivic does not provide legal, immigration, or tax advice; independent professional advice should be obtained where required.
Jomivic may refuse, suspend, or withdraw services where information is inaccurate, misleading, or incomplete; where services may breach applicable laws; or where continued engagement may expose Jomivic to legal, regulatory, or reputational risk.
Section 2
Term and Termination
These Terms take effect on the date you first access the website or use any services and continue unless terminated in accordance with this section. Jomivic may suspend or terminate access to the website or services (in whole or in part, with or without notice) where you breach these Terms, misuse the website or services, or where required by law, regulation, or an order of a competent authority.
You may cease using the website or services at any time. Termination does not relieve obligations incurred prior to termination, including payment of outstanding fees, confidentiality obligations, and liability arising from prior use.
Upon termination, rights granted under these Terms cease immediately and Jomivic may disable or restrict access. Provisions intended to survive termination (including confidentiality, intellectual property, limitation of liability, indemnification, and governing law) survive termination.

Modifications of the Services or These Terms
Jomivic may modify, enhance, suspend, restrict, or discontinue any aspect of the website or services at any time. Jomivic is not liable for loss or damage arising from such changes, except where liability cannot be excluded under applicable law.
Jomivic may amend these Terms to reflect changes in laws, services, business practices, operational structure, or technical/security developments. Revised Terms take effect on publication unless otherwise stated. Continued use after publication constitutes acceptance; if you do not agree, you must discontinue use.
Section 4
Usage Rights; Restrictions; Support
Subject to compliance with these Terms, Jomivic grants a limited, non-exclusive, non-transferable, revocable right to access and use the website and services solely for lawful recruitment and employment-related purposes. This is not a sale or transfer of intellectual property rights.
You must not misuse the website or services. Without limitation, you must not:
- Attempt to gain unauthorised access to any part of the website, systems, or networks.
- Copy, scrape, extract, reproduce, or commercially exploit content without prior written consent.
- Upload or transmit unlawful, misleading, defamatory, or harmful material.
- Use automated tools, bots, or scripts without express authorisation.
Jomivic may provide reasonable support, but does not guarantee response times or uninterrupted availability. Access may be restricted for maintenance, security, or operational reasons without liability.
Section 5
Payment Terms; Fees; Automatic Renewal
Certain services (particularly services to clients) may be subject to fees. Fees, payment terms, invoicing arrangements, and any applicable replacement or refund policies are agreed separately in writing and form part of the binding agreement between the parties.
Unless otherwise agreed in writing, invoices are payable within the timeframe stated on the invoice. Jomivic may suspend or terminate services where payment is overdue, without prejudice to other rights or remedies.
For the avoidance of doubt
- Candidates are not charged for job placement services unless expressly permitted by law and agreed in writing.
- Fees are exclusive of applicable taxes unless stated otherwise.
- Late payments may attract interest or recovery costs to the extent permitted by law.
Where services are provided on a recurring or ongoing basis, services may renew automatically in accordance with the agreed commercial terms unless terminated in writing in accordance with those terms.
Section 6
Proprietary Rights and Confidentiality
All intellectual property rights in and to the website, services, content, branding, logos, databases, and materials made available by Jomivic remain the exclusive property of Jomivic or its licensors. Nothing grants you rights beyond the limited right to use the website and services in accordance with these Terms.
You must treat as confidential all non-public information disclosed by Jomivic in connection with the services, including business information, pricing, methodologies, client data, candidate data, and technical information. Confidential information must not be disclosed or used for any purpose other than permitted use, except where required by law or permitted in writing.
Jomivic treats personal and confidential information received from clients and candidates in accordance with applicable data protection laws, including GDPR and the Irish Data Protection Act 2018, and in accordance with our Privacy Policy.
Section 7
Publicity
Unless agreed in writing, you agree that Jomivic may identify clients as customers in marketing/promotional materials (including website content), provided that no confidential information or personal data is disclosed. This may include the display of company names, logos, or general descriptions of services provided.
Jomivic will not issue press releases or detailed case studies relating to a client without prior written consent. Candidates’ personal details will not be used for publicity purposes without explicit consent in accordance with data protection laws.
Section 8
User Content
Users may submit or upload content (including CVs, cover letters, employment histories, qualifications, job descriptions, and other information) (“User Content”). You retain ownership of User Content; however, by submitting it you grant Jomivic a non-exclusive, worldwide, royalty-free licence to use, store, reproduce, process, and share such content solely for providing the services.
You represent and warrant that User Content:
- Is accurate, current, and complete.
- Does not infringe third-party rights.
- Complies with applicable laws and regulations.
Jomivic does not independently verify User Content and is not responsible for errors or inaccuracies. Jomivic may remove, restrict, or refuse to process User Content that violates these Terms or applicable law.
Section 9
Warranties and Limitation of Liability
The website and services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Jomivic disclaims all warranties (express, implied, or statutory) including merchantability, fitness for purpose, accuracy, reliability, and non-infringement.
Without limitation, Jomivic does not warrant that:
- The website or services will be uninterrupted, timely, secure, or error-free.
- Defects will be corrected.
- Services will result in successful recruitment, employment, or retention.
To the maximum extent permitted by Irish law, Jomivic is not liable for indirect, incidental, special, consequential, or economic loss (including loss of profits, business opportunity, data, or goodwill) arising from use of or inability to use the website or services.
Nothing excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded or limited under applicable law.

Indemnification
You agree to indemnify, defend, and hold harmless Jomivic (and its directors, officers, employees, agents, contractors, and affiliates) from and against claims, demands, actions, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your access to or use of the website or services, your User Content, breach of these Terms, violation of applicable law, or infringement of third-party rights. This indemnity survives termination or expiry.

Governing Law; Jurisdiction

eSignature Service
Where documents or acceptances are executed electronically (including electronic signature), you agree electronic execution is legally valid and binding and has the same legal effect as handwritten signature, in accordance with applicable laws (including the EU eIDAS Regulation).
You consent to receiving communications, agreements, and notices electronically and acknowledge electronic records satisfy legal requirements for written documentation.
Section 17
General Provisions
These Terms constitute the entire agreement between you and Jomivic relating to use of the website and services and supersede prior agreements or understandings (written or oral). If any provision is invalid/unenforceable, it will be modified to the minimum extent necessary to be enforceable and the remaining provisions remain in effect.
No failure or delay by Jomivic to exercise any right/remedy is a waiver. You may not assign or transfer rights/obligations without Jomivic’s prior written consent; Jomivic may assign these Terms as part of a business transfer or reorganisation.
